Who is the Data Controller?

Keder Enterprises B.V., registered with the Chamber of Commerce in Amsterdam under number 34310090, also operating under the trade name KederLegal, is the data controller for the processing of personal data.

Which data does KederLegal process?

When you or your employer request or use a service from KederLegal, we ask for personal data. Which data we process depends on the nature of our contact with you:

• If you request information from us, we ask you to provide your contact details so that we can send you the requested information.
• If you become a client, we will at minimum need contact details (name, position, address, place of business, telephone number and email address). We use this data to perform the agreement we have with you. Depending on the nature of the work we carry out for you, we may process additional data.
• If your information has been provided to us by one of our clients in connection with the agreement to be performed.
• If there is a potential collaboration in service delivery, we may request your CV and possibly other personal data.

Why does KederLegal process personal data?

The purposes for processing personal data are:

• To contact you
• For the performance (and formation) of an agreement
• For marketing and communication activities
• To comply with legal and statutory obligations

Legal bases

To be permitted to process personal data, KederLegal relies on the following legal bases:

• Necessary for the performance of the agreement, such as for providing services to you as a client
• Compliance with a legal obligation, such as retaining invoices for tax authorities
• The processing is necessary for the purposes of our legitimate interests; these are: being able to carry out an assignment from our client (for which we need to be in contact with you); marketing and acquiring new assignments.
• Consent, such as to inform you, at your request, about our services

How does KederLegal obtain your data?

In virtually all cases, we receive the data directly from you. In addition to the information we receive from you, we may also receive and process data from third parties, for example from your employer, client or data available in publicly accessible sources such as the trade register at the Chamber of Commerce or LinkedIn.

How does KederLegal handle your data?

We handle your data with care and take the necessary technical and organisational measures to ensure an appropriate level of protection.

Retention of data

We do not retain personal data longer than necessary. In some cases, the law determines how long we may or must retain data. Client files are retained for a maximum of 20 years after the end of the relationship.

Sharing of data

KederLegal only shares personal data with third parties if this is necessary for business operations or if KederLegal is legally obliged to do so. This occurs in the following cases:

Service providers and companies we collaborate with.

• We sometimes engage other companies to perform services for us related to the agreement we have with our clients. These may include, for example, another advisor, accountant or a collection agency.
• In some cases, we outsource the processing of personal data to third parties, for example an accountant. These service providers qualify as processors. Where such a party qualifies as a processor, KederLegal has made the necessary contractual arrangements with them to ensure the confidentiality and security of your data.

Government authorities

In some cases, we are legally obliged to provide personal data to government authorities. This includes, for example, the Tax Authority or regulatory bodies.

Your rights

Access or correction of data

You have the right to access your personal data. You can therefore request which personal data we hold about you and for what purposes we use it. You can submit an access request by sending a letter or email. Please ensure that your name, address, landline and/or mobile telephone number and a redacted copy (without passport photo and national identification number) of a valid identity document are included with this request. You can submit the request via the details listed under 'Contact'. You can also, if necessary, have your data corrected by us if it is incorrect. You can contact us as indicated under "Contact". We will ask verification questions to identify you. You will receive a response from us within four weeks.

The right to be 'forgotten'.

In some cases and under certain conditions, you have the right to have the personal data we hold about you erased. This applies when:

1. the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
2. you have withdrawn your consent for processing;
3. your personal data has been unlawfully processed by us;
4. there is a legal obligation to erase the personal data;

Restriction of processing

If you believe that we are unlawfully processing your personal data or that the data we process is incorrect, you can request a restriction of processing.

Consent

KederLegal only requests consent when this is necessary as a legal basis for the processing of your personal data. If we process your personal data based on your consent, you can withdraw your consent at any time. You can do this by contacting us via the details mentioned under "Contact". This can be done by telephone or email.

Right to data portability

You have the right to receive a copy of the personal data you have provided to us for the performance of an agreement you have entered into with us or based on your consent. This only concerns personal data that we have received from you directly and not data that we have received from third parties. This enables you to easily transfer the data you have provided to another party.
